DISCLAIMER POLICY

1. PURPOSE This Disclaimer Policy governs the purchase, possession, handling, and use of the lithium battery-powered ("LR100 GPS Tracking Unit") and Smart Spray Hardware of SMART SPRAY TECHNOLOGIES, LLC. (collectively with its affiliates, “Smart Spray” or “We”, “Us”) . By purchasing, possessing, charging, operating, or otherwise using the LR100 GPS Tracking Unit and Smart Spray Hardwarethe customer acknowledges and agrees to the terms and conditions set forth in this Disclaimer Policy.

The LR100 GPS Tracking Unit must be used only in accordance with applicable laws, regulations, safety standards, and the manufacturer's instructions.

2. PERMITTED USE OF THE LR100 GPS TRACKING UNIT The LR100 GPS Tracking Unit is intended solely for lawful and responsible use. a. Permitted uses include: i. Application of liquid chemicals to properties for which the LR100 GPS Tracking Unit is designed. ii. Use by competent, trained, adults who understand the LR100 GPS Tracking Unit's operation and safety requirements. iii. Use in accordance with the operating instructions, warnings, and safety guidelines provided by the manufacturer. iv. Charging and storing the LR100 GPS Tracking Unit only as directed by the manufacturer. v. Use in environments that are reasonably safe, dry, and suitable for operation of battery-powered tools.

NOTE: Users must exercise reasonable care and judgment when operating the LR100 GPS Tracking Unit and must immediately discontinue use if any defect, malfunction, overheating, or damage is observed.

3. PROHIBITED USE OF THE LR100 GPS TRACKING UNIT a. The LR100 GPS Tracking Unit shall not be used: i. For any unlawful, dangerous, reckless, or negligent purpose. ii. In a manner inconsistent with the manufacturer's instructions or intended purpose. iii. By children or untrained persons to operate the LR100 GPS Tracking Unit. iv. While under the influence of alcohol, drugs, medication, or any condition that may impair judgment or coordination. v. In explosive, flammable, or otherwise hazardous environments unless specifically authorized by the manufacturer. vi. If the LR100 GPS Tracking Unit, battery, charger, or accessories appear damaged, modified, defective, or improperly repaired. vii. With unauthorized batteries, chargers, components, or accessories. viii. In any manner that may cause injury to persons, damage to property, or harm to the environment. ix. After any safety feature has been removed, altered, bypassed, or disabled. x. For any purpose that exceeds the LR100 GPS Tracking Unit's intended design limitations. xi. The manufacturer, seller, distributor, and affiliates assume no responsibility for damages or injuries resulting from prohibited use.

4. LITHIUM BATTERY SAFETY INSTRUCTIONS The LR100 GPS Tracking Unit contains a lithium battery, users must follow these safety requirements at all times: a. Charging Safety i. Use only the charger supplied with, or specifically approved for, the LR100 GPS Tracking Unit. ii. Charge the battery in a well-ventilated area away from combustible materials. iii. Do not leave the LR100 GPS Tracking Unit charging unattended for extended periods. iv. Disconnect the charger after charging is complete.

b. Handling Safety i. Do not puncture, crush, drop, disassemble, or modify the battery. ii. Do not expose the battery to fire, sparks, open flames, or excessive heat. iii. Do not short-circuit battery terminals. iv. Avoid contact with water, saltwater, or other conductive liquids.

c. Storage Safety i. Store the LR100 GPS Tracking Unit in a cool, dry location. ii. Keep away from direct sunlight, excessive temperatures, and moisture. iii. Store out of reach of children and unauthorized users. iv. Do not store damaged or swollen batteries.

d. Inspection and Maintenance i. Regularly inspect the LR100 GPS Tracking Unit, battery, and charger for signs of wear, damage, leakage, corrosion, swelling, or overheating. ii. Discontinue use immediately if any abnormal condition is detected. iii. Contact the manufacturer or authorized service provider regarding battery replacement or disposal.

e. Disposal i. Do not dispose of lithium batteries in household trash, fire, or incinerators. ii. Dispose of batteries in accordance with all applicable local, state, federal, and international laws and regulations. iii. Utilize approved battery recycling or hazardous waste collection facilities where available.

f. Emergency Situations If the battery emits smoke, unusual odors, excessive heat, sparks, or shows signs of thermal runaway:

i. Immediately discontinue use if safe to do so. ii. Move away from the LR100 GPS Tracking Unit and keep others at a safe distance. iii. Contact emergency services if a fire or hazardous condition develops.

Follow all local emergency response guidance.

5. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the manufacturer, seller, distributor, and their respective officers, employees, agents, affiliates, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from: (i) Improper use of the LR100 GPS Tracking Unit; (ii)Failure to follow safety instructions; (iii) Unauthorized modification, repair, or alteration; (iv) Misuse, abuse, negligence, or accidents; (v) Battery-related incidents; (vi) Failure to comply with applicable laws or regulations.

The user assumes all risks associated with ownership, handling, storage, charging, transportation, and operation of the LR100 GPS Tracking Unit.

6.Regulatory Compliance and Chemical Use The Customer acknowledges that the use, storage, handling, transportation, and application of pesticides, herbicides, fertilizers, and other regulated chemicals may be subject to applicable federal, state, and local laws, regulations, permits, licensing requirements, and governmental approvals, including those administered by the United States Environmental Protection Agency ("EPA") and applicable state or local regulatory authorities. The Customer is solely responsible for ensuring that it, and all individuals operating the Smart Spray Services on its behalf, possess and maintain all licenses, certifications, permits, registrations, and other authorizations required to purchase, possess, transport, handle, mix, store, or apply any regulated chemicals. The Customer shall comply with all applicable laws, regulations, labeling requirements, safety standards, and manufacturer instructions relating to the use of such chemicals. Smart Spray provides hardware, software, and related services only and does not manufacture, sell, supply, recommend, supervise, or control the Customer's selection, handling, storage, mixing, transportation, or application of any regulated chemicals. Accordingly, Smart Spray shall have no responsibility or liability for the Customer's use of regulated chemicals or for any violation of applicable laws, regulations, permit conditions, or licensing requirements by the Customer or its personnel. The Customer shall defend, indemnify, and hold harmless Smart Spray and its affiliates, officers, directors, employees, and agents from and against any claims, actions, liabilities, fines, penalties, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to the Customer's failure to obtain or maintain required licenses, permits, certifications, or approvals, or the Customer's use, storage, handling, transportation, or application of regulated chemicals in violation of applicable law.

ACKNOWLEDGMENT AND ACCEPTANCE

BY PURCHASING, POSSESSING, ACCESSING, OR USING THE LR100 GPS TRACKING UNIT AND SMART SPRAY HARDWARE THE CUSTOMER ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO THIS DISCLAIMER POLICY IN ITS ENTIRETY.

The customer further acknowledges and agrees that:

a. They are responsible for using the LR100 GPS Tracking Unit safely and lawfully. b. They understand the risks associated with lithium battery-powered devices. c. They will comply with all safety instructions and warnings. d. They assume all responsibility for any consequences arising from their use, misuse, storage, charging, transportation, or handling of the LR100 GPS Tracking Unit. e. Customer is solely responsible for possess, transport, handle, mix, store of chemicals used with the Smart Spray Hardware. Smart Spray only provides the hardware and assumes no responsibility or liability for any chemicals used in connection with the hardware. If the customer does not agree to the terms of this Disclaimer Policy, they should not purchase, use, or operate the LR100 GPS Tracking Unit.
